Terms of Service

Last updated: July 2026

These Terms of Service ("Terms") govern access to and use of the Rootera website, database, search tools, and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Description of the Service

The Service provides access to a searchable index of historical archival records, including materials derived from the 1897 Census of the Russian Empire and related archival documents.

The Service includes machine-generated indexing, text recognition, metadata extraction, search functionality, document references, and related research tools.

The Service is intended solely as a supplementary research aid and informational tool.

2. Nature of the Data

The indexed data available through the Service is generated and processed using automated technologies, including optical character recognition (OCR), language models, and other computational methods.

As a result:

  • records may contain transcription errors;
  • names may be incorrectly recognized;
  • entries may be incomplete;
  • metadata may contain inaccuracies;
  • search results may omit relevant records;
  • false matches or incorrect associations may occur;
  • historical spellings and damaged documents may affect recognition quality.

The Service does not guarantee the accuracy, completeness, reliability, or historical correctness of any indexed data or search result.

Users acknowledge that all data provided through the Service is informational in nature and must be independently verified against original archival documents.

3. Original Archival Documents

Original archival materials remain the authoritative source of historical information.

Users are solely responsible for verifying any information, conclusions, interpretations, genealogical findings, or research outcomes using original archival records where appropriate.

The Service does not certify or authenticate the historical accuracy of any record, transcription, interpretation, or search result.

4. Access and Payments

Certain features of the Service may require payment in order to obtain extended or full access to indexed records, archival references, document images, filters, or related research functionality.

Access is granted for the specific period, scope, or conditions presented at the time of purchase.

Prices displayed may vary depending on your country of access. We apply Purchasing Power Parity (PPP) pricing to make the Service more accessible across different regions.

All payments are final unless otherwise required by applicable law.

By purchasing access, the user acknowledges and agrees that:

  • the Service provides digital content and immediate digital access;
  • search results and record availability are not guaranteed;
  • historical records may be incomplete or inaccurate;
  • inability to locate specific individuals or records does not constitute grounds for refund;
  • errors, omissions, or inaccurate search results do not constitute grounds for refund.

5. No Warranties

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, the Service provider disclaims all warranties, whether express or implied, including but not limited to:

  • accuracy;
  • completeness;
  • reliability;
  • fitness for a particular purpose;
  • uninterrupted availability;
  • merchantability;
  • non-infringement.

The Service provider does not warrant that the Service will be error-free, continuously available, or free from inaccuracies or technical defects.

6. Limitation of Liability

To the fullest extent permitted by applicable law, the Service provider shall not be liable for:

  • inaccuracies in indexed data;
  • transcription or recognition errors;
  • omitted or incomplete records;
  • incorrect search results;
  • historical inaccuracies;
  • research conclusions made by users;
  • loss of data;
  • business interruption;
  • indirect, incidental, consequential, or special damages.

In all circumstances, the total liability of the Service provider shall not exceed the amount paid by the user for access to the Service during the twelve (12) months preceding the claim.

7. Intellectual Property

The Service interface, indexing structure, database organization, search systems, software, design, and machine-generated data processing are protected by applicable intellectual property laws.

Original archival materials, scans, and source documents may belong to third-party archives, libraries, or institutions.

Nothing in these Terms transfers ownership of archival source materials to users.

8. Permitted Use

Users may use the Service solely for lawful personal, historical, genealogical, academic, or research purposes.

Users may not:

  • scrape or systematically extract data from the Service;
  • attempt to reverse engineer the Service;
  • interfere with the operation of the Service;
  • reproduce or redistribute substantial portions of the database without permission;
  • use automated systems to overload or access the Service excessively;
  • use extracted data for commercial purposes without explicit written permission.

The Service provider reserves the right to suspend or permanently block any user account, without prior notice or explanation, if there is reason to believe that these Terms have been violated or that the Service is being used in an unauthorized manner.

9. Availability and Modifications

The Service provider reserves the right to modify, suspend, restrict, or discontinue any part of the Service at any time without liability.

The Service provider may update indexed records, search systems, algorithms, or access conditions without prior notice.

10. Third-Party Sources

The Service may reference or incorporate archival materials obtained from public archives, libraries, or other third-party sources.

The Service provider does not claim ownership over original archival materials unless explicitly stated.

Users are responsible for complying with any applicable archival usage rules or source attribution requirements.

11. Privacy

Use of the Service may also be governed by a separate Privacy Policy.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Latvia, without regard to conflict of law principles.

Any disputes arising in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Latvia.
